Your use of Elearn's products, software, services and web sites is subject to the following Terms of Use between you and Elearn (meaning ELEARN Ltd). Elearn reserves the right to update and change the Terms of Use from time to time without notice. Description and use of the Service

Elearn provides users with access to personalized content and other services, in the Terms of Use, henceforth called Service. You also understand and agree that the Service may include advertisements and that these advertisements are necessary for Elearn to provide the Service.

Your use of the Service is at your sole risk. You understand and agree that the Service is provided as-is and as-available and that Elearn does not represent or warrant to you that your use of the Service will meet your requirements, that the Service will be uninterrupted, timely, secure or free from error, that any information obtained by using the Service will be accurate or reliable, and that any defects (errors) of software as the part of the Service will be corrected.

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including, but not limited to, copyright laws).

Content and Copyright

You understand that you and not Elearn, are entirely responsible for all the information, data, text, messages or other materials, whether publicly posted or privately transmitted via the Service. Elearn does not control such Content posted and does not guarantee the accuracy, integrity or quality of such Content. You understand that you may be exposed to Content that is offensive, obscene, unlawful, threatening, indecent, pornographic, objectionable, or that otherwise violates any party's intellectual property or these Terms of Use. We may, but have no obligation to, remove such Content.

Verbal, physical, written or other threats or abuse of any Elearn customer, employee or member will result in immediate account termination.

You must not upload, post, host, or transmit unsolicited email, SMSs, or spam messages. You must not transmit any worms or viruses or any code of a destructive nature. Please read our Anti-Spam Policy below.

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use and access, including HTML/CSS or visual design elements, unless this is permitted or unless you have been specifically told that you may do so by Elearn, in writing.

Anti-Spam Policy

Elearn takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our Service. Very simply this means that customers of Elearn may not use or permit others to use our Service to transact in UCE; that is transmit, distribute or deliver any bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail. Each User of our Service is ultimately responsible for their actions.

E-mail sent, or caused to be sent, to or through our Service may not:

  • Use or contain invalid or forged headers and invalid or non-existent domain names.
  • Employ any technique (including "robots") to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path.
  • Use other means of deceptive addressing.
  • Using or causing Elearn computer systems to be used to facilitate the transmission of unsolicited or unauthorized material. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available.
  • Relaying email from a third party's mail servers without the permission of that third party.
  • Contain false or misleading information in the subject line or otherwise contain false or misleading content.
  • Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.
  • Otherwise violating Elearn's Privacy Policy, Terms of Use and this Anti-Spam Policy.

Cancellation and Termination

You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time with a simple no-questions-asked cancellation button. All of your content will be immediately deleted upon cancellation. This information can not be recovered once your account has been cancelled. If you cancel before the end of your current payment period, your cancellation will take effect immediately. There will be no refunds or credit for partial months of Service.

You agree that Elearn may for any reason at any time, terminate its legal agreement with you, including the termination of your account, and refuse any and all current or future use of any Elearn service.

Technical Conditions

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.

Limitation of Liability

You expressly understand and agree that Elearn shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Elearn has been advised of the possibility of such damages), resulting from:

  1. The use or the inability to use the Service,
  2. The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service,
  3. Unauthorized access to or alteration of your transmissions or data,
  4. Statements or conduct of any third party on the Service or
  5. Any other matter relating to our services

Modifications to the Service and Prices

Elearn reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the Service or any part of the Service with or without notice. You agree that Elearn shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Links to other web sites

The Service may provide links to other World Wide Web sites or resources. Because Elearn has no control over such sites and resources, you acknowledge and agree that Elearn is not responsible for the availability of any such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on, or available from such sites or resources. You acknowledge and agree that Elearn is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources.
